Terms rape molestation

by AnxiousGurl, Nov 04, 2008 06:25PM
Could someone please clarify......
When I hear someone is raped I tend to think forced to have sex with...but isnt it their raped of their innocence(if a child) and for an older person it means:violated?
Does molestation always mean you were molested(touched) What if you werent, but were forced to touch to someone else... against your will....what is the term for that? Is there a "term"
Can you still bring someone to court or file a complaint years and years later....or is it too late?

I honestly do not know if there is an offical difference in the words, but they really mean the same thing. As for whether or not you can go back years later and file a complaint, I do believe that depends on the laws in your state. Some state I believe do allow it, because people who do suffer severe trauma tend to suppress memories, that may show up later in life.

Anxious,  these are legal questions.

"Rape" does mean sexual penetration.  It can be statutory (sex that was consensual but one party isn't old enough to give legal consent) or can be forced sex between adults,  or an adult or a child.

Being forced to touch someone against your will can be called Lewd and Lascivious behavior,   sexual assault,  sexual contact with a minor,  etc.

If this contact happened to a minor,  the "statute of limitations" when they can file a criminal complaint usually starts when the minor reaches 18,  so it's a long time.

Sounds like you have a good lead, but the best is to talk toa lawyer. Through my county bar, I can talk to a new one on a new case for almost free. Maybe your county bar offers the same opportunity forlegal advice.
